DAP helps challenge PIP assessment for autistic man with severe stammer and ADHD

 

Disability Advice Project (DAP) helped a 23-year-old man with autism and severe communication difficulties successfully challenge an assessment by Capita, and then a decision by the DWP, to deny him Personal Independence Payment (PIP).

At the recent appeal tribunal, via video, it was held that the young man is entitled to PIP with the mobility component at standard rate and the daily living component at enhanced rate, for ten years.

His PIP claim was previously denied. In September 2019, the client was awarded zero points at an assessment lasting just 20 minutes.

DAP became involved in the appeal process and worked in collaboration with Pobl Torfaen Vulnerable Adults service which provides housing related support. A referral for this service can be placed via Gateway on 01495 766949 or via email gateway@torfaen.gov.uk

DAP helped Pobl to collate historical documents, such as his medical history, statement of special educational needs and a supporting statement. DAP also commissioned a report by an occupational therapist. This described how you must ‘tune into’ the client to really appreciate his needs and detailed the challenges he faces every day.

Martin Lewis, volunteer and caseworker at DAP, said: “It was important for the Tribunal Hearing Panel to see his difficulties communicating and hear from experts about his disability. This young man is autistic, has a severe stammer, and needs help to get around and do daily activities. He is extremely anxious and easily disorientated.

“This complex case highlights the need for expert advice in supporting PIP appeals – without hours of case work and perseverance he wouldn’t have got the support he urgently needs. He waited a very long time for the appeal and suffered emotional stress and financial hardship.”
